...satire or parody?
If a game had a level based inside of the Youtube website, could the developers do that?

Spoof is fair use but you can't use the name. It would have to be called something like Yuutube.

Just be careful of Nintendo. They will take down pretty much anything.

...satire or parody? If a game had a level based inside of the Youtube website, could the developers do that? It depends. As Bill said, parody can be called fair use, but if Google decided they didn't like the way YouTube was being portrayed in your level, they could sue. You can shout "fair use" all you want, but a legal battle with Google is probably best avoided. I'm not a lawyer, but if this is something that you are going to do, I'd recommend you hire one. It would probably be smart to talk to someone at Google, too. They'd most likely ask that YouTube isn't called by its real name and that there are visual distinctions between your level and their site. Think something more along the lines of "MeTube" or "TheyTube" (or something creative) rather than a simple misspelling or a font change.

That's kind of a pity. I had this great idea of someone hired by Sega to infiltrate Nintendo to assassinate Shigeru Miyamoto. So, who does one of teh gmaing greats work for now? Nine-ten-go or someone?

That's kind of a pity. I had this great idea of someone hired by Sega to infiltrate Nintendo to assassinate Shigeru Miyamoto. So, who does one of teh gmaing greats work for now? Nine-ten-go or someone? This reminds me Sega did some parodies like this in Segagaga, the Shenmue demo and in the last Segata Sanshiro commercial (though it was Sony instead of Nintendo). Parody is fair use; the problem is that, even if the law allows it, the offending company might still take you to court over it - they would have no intention of actually winning on the court, the intention would be just to dry your pockets until you gave up. That's how, for example, all those "patent/copyright trolls" work, like the guy who owned the name "Edge": most people will settle because fighting the lawsuit gets too expensive (the guy was only brought down when he decided to go after EA over "Mirror's Edge", and you just don't mess with EA's lawyers, ever). So, the lesson here is: copyright laws, especially in the US, suck; it's too risky even when you're allowed to do something. That's why it's just better to change names. Maybe Saga is sending a hired assassin to In-trendo or something?

Animes do it all the time. Hunter x Hunter parodied the Sony Playstation vis a vis the ever-popular " Joy Station."
